After court ruling, Florida maintains the ban on cultivated meat
A federal appeals court enabled Florida to keep in force the law that prohibits the production and commercialization of cultivated meat, considering that it does not conflict with federal regulation. The decision supports the validity of SB 1084, in force since July 2024.
The case was driven by the company Upside Foods, which argued that federal regulation should prevail. However, the court understood that the state law does not interfere with technical aspects under federal control, such as ingredients or production processes.
Florida was the first state to move forward with this type of restriction, and it was later followed by six other states. Local authorities defended the measure as a way to protect traditional producers, while the cultivated meat industry warns that these decisions slow the development of the sector and competition.
The regulation prohibits the manufacture, sale, and distribution of these products and provides for penalties that may include up to 60 days in prison.
